These Terms explain the general conditions for accessing and using the “Merikh OS Factory” and its publicly available digital services.

Commercial use of the Merikh platform, implementation, support, integrations, and related professional services will be governed by a separate written agreement between Merikh and the Customer.

By using “Merikh OS Factory” products, you agree to these Terms.

1. About Merikh

Merikh develops software and intelligent solutions that help industrial organizations better understand, manage, and improve their operations.

These Terms apply to any digital service that refers to them. They do not replace the commercial agreement signed with a Customer.

2. Using Our Website

You may use the Merikh website to learn about our products and services, access published resources, contact our team, or request a demonstration.

You agree to use the website lawfully and in a way that does not:

  • Disrupt its availability or security.
  • Attempt to gain unauthorized access to any account or system.
  • Introduce harmful software or code.
  • Misuse the website or its content.
  • Infringe the rights of Merikh or any third party.

We may restrict access where necessary to protect our website, users, or legal rights.

3. Accounts and Access

Some services may require an account or authorized access.

You are responsible for providing accurate information, protecting your login credentials, and informing us if you suspect unauthorized access to your account.

Access to the Merikh platform and the permissions available to each user will be determined by the relevant Customer agreement and account configuration.

4. Commercial Services

The scope of services provided to each Customer including implementation, integrations, subscriptions, support, pricing, service levels, and project responsibilities, will be defined in a separate written agreement.

Nothing published on this website constitutes a binding commercial offer unless expressly confirmed by Merikh in writing.

5. Customer Data

Customers retain ownership of the data they provide to Merikh.

The collection, processing, storage, access, retention, and deletion of Customer data will be governed by the applicable agreement, privacy policy, and any relevant data-processing arrangements.

Customers are responsible for ensuring that they have the necessary rights and permissions to provide such data to Merikh.

6. Responsible Use of Insights

Merikh may provide analytics, recommendations, forecasts, or AI-assisted insights to support operational decisions.

These outputs are intended to assist qualified users and should be evaluated in the context of the Customer’s own knowledge, processes, and responsibilities.

Unless specifically agreed otherwise in writing, the Customer remains responsible for its operational decisions and for determining how Merikh’s outputs are used.

7. Intellectual Property

The Merikh website, platform, software, designs, documentation, trademarks, and related materials belong to Merikh or its licensors and are protected by applicable intellectual-property laws.

You may not copy, modify, distribute, sell, reverse engineer, or commercially exploit these materials without written permission, except where permitted by law or an applicable agreement.

Customers retain ownership of their own data and materials.

8. Third-Party Services

The Merikh products may include links to, or integrations with, third-party products and services.

Those products and services are governed by their own terms and policies. Merikh is not responsible for third-party services that it does not own or control.

9. Availability and Changes

We work to keep our website and digital services reliable and up to date. However, access may occasionally be interrupted for maintenance, updates, security, or circumstances outside our reasonable control.

We may update the website, its content, or these Terms as our services and legal requirements evolve.

Specific availability commitments for paid services will be defined in the applicable Customer agreement.

10. Limitation of Responsibility

The public website and its content are provided for general informational purposes.

To the extent permitted by applicable law, Merikh is not responsible for losses resulting from unauthorized use, reliance on incomplete public information, third-party services, or circumstances outside its reasonable control.

Any warranties, responsibilities, and limitations relating to commercial services will be determined by the applicable written agreement.

11. Ending Access

You may stop using the Merikh products at any time.

Access to commercial services may be suspended or terminated according to the relevant Customer agreement or where continued access creates a serious legal, security, or misuse concern.

12. Resolving Disputes

We believe that concerns should first be addressed through direct and good-faith communication.

For commercial engagements, the governing law, jurisdiction, and dispute-resolution process will be specified in the relevant written agreement between Merikh and the Customer.

13. Changes to These Terms

We may revise these Terms when our services, business practices, or legal obligations change.

The latest version will be published on this page together with its effective date. Continued use of the website after an update means that the revised Terms apply to your use.
